Indian Child Welfare Assistance Program

The Federal Indian Child Welfare Act was enacted into law by Congress in 1978 in response to the widespread adoption of Indian children. The Law was passed "to protect the best interest of Indian Children and promote the stability of Indian Tribes and families". The Indian Child Welfare Act provides for the retention by an Indian Tribe of exclusive jurisdiction over child custody proceedings involving specified Indian children. The Indian Child Welfare Act Amendments requires a party seeking the involuntary placement of an Indian child or the involuntary termination of parental rights to provide written notice to the Indian child's Tribe.
